Multi-State Federal Contracts and Prevailing Wage Requirements

Federal contracts that involve construction in multiple states or counties require careful attention to Davis-Bacon compliance — each county has its own wage determination, and rates can vary significantly between locations.

One WD Per County

The fundamental rule is that the wage determination for the county where work is performed governs the workers doing that work. If your project includes work in three different counties — even in the same state — you may have three different WDs to track.

Payroll Segregation

For multi-county projects, payroll records must be maintained in a way that demonstrates which workers worked in which counties on which days. This is critical for certified payroll submissions and any DOL audit.

Mobile Crews

Workers who travel between counties in a single day should be paid the applicable rate for each county based on hours worked. If a worker spends 4 hours in County A and 4 hours in County B, both counties' rates apply to the respective hours.
