Conformance Requests Under Davis-Bacon

Every federal construction project must pay workers the rates listed in the applicable wage determination. But what happens when a project requires a type of work — and a worker classification — not listed in that WD?

What Is a Conformance?

A conformance is the process of adding a new trade classification and wage rate to an existing wage determination. It is used when project work requires a classification that was omitted from the WD when it was issued.

How to Submit a Conformance Request

  1. Identify the unlisted classification as soon as possible — ideally before work begins
  2. Notify the contracting agency in writing
  3. The agency submits Form SF-1444 to the DOL Wage and Hour Division within 30 days
  4. DOL reviews and either approves the proposed rate or sets a different rate

What Rate Will Be Set?

The conformed rate must bear a reasonable relationship to existing WD rates. DOL considers the skill level of the classification relative to listed trades.
